1. The Service
Talent Attractor is a software-as-a-service platform that helps real estate Team Leaders and Market Center leadership track agent recruiting prospects, log communications, run AI-assisted coaching, and book meetings. We may add, change, or remove features over time.
2. Eligibility & account
- You must be at least 18 years old and authorized to enter into a contract on behalf of any organization you represent.
- You're responsible for keeping your sign-in credentials secure and for all activity under your account.
- If you sign in via Google, your access is governed by both these Terms and Google's Terms of Service.
- Each tenant (workspace) is owned by an admin who can invite team members. Admins are responsible for the actions of users in their workspace.
3. Acceptable use
You agree not to:
- Use the Service for unlawful purposes, including violation of TCPA, CAN-SPAM, or any applicable real estate licensing rules in your jurisdiction.
- Send unsolicited bulk email, SMS, or calls to anyone who has opted out, asked to be removed, or never opted in.
- Upload or store data you don't have the right to use.
- Attempt to bypass tenant isolation, access another tenant's data, or reverse-engineer the Service.
- Use the Service to harass, defame, or discriminate against any person or group.
- Resell, white-label, or sublicense the Service without our written agreement.
You are solely responsible for compliance with anti-spam, telemarketing, and data-protection laws applicable to your outreach. The Service provides tools (opt-out tracking, STOP detection, DNC flags) to help you stay compliant — but using them is your responsibility.
4. Your data
- You retain ownership of all data you upload to the Service ("Your Data").
- You grant us a non-exclusive, worldwide license to host, process, and display Your Data solely to provide the Service to you.
- You may export or delete Your Data at any time using the in-app tools or by emailing us.
- We will not sell Your Data, train AI models on Your Data, or share it with other tenants.
How we collect and handle Your Data is described in our Privacy Policy.
5. Subscriptions & billing
- Plan tiers, prices, and included usage are listed on our pricing page.
- Subscriptions renew automatically at the end of each billing period until canceled.
- You can cancel anytime — your account will remain active through the end of the period you've paid for.
- Refunds are issued on a case-by-case basis. We do not pro-rate refunds for partial months.
- We may change pricing for new billing periods with at least 30 days' notice by email.
6. AI features
The Service includes AI-powered features (drafting, summarizing, coaching) provided by Anthropic's Claude models. AI output may contain errors, fabrications, or biased content. You are responsible for reviewing and approving any AI-generated content before sending it to a prospect or acting on it. We make no guarantees about the accuracy of AI output.
7. Third-party integrations
The Service connects to third-party services (Google Calendar, Gmail, OpenPhone, etc.) at your option. Your use of those services is governed by the third party's own terms. We are not responsible for changes, downtime, or data loss in third-party services.
8. Service availability
We work to keep the Service available, but we do not guarantee uninterrupted access. We may perform scheduled maintenance, push updates, or experience unplanned downtime. We will not be liable for any losses caused by Service unavailability.
9. Termination
- You can close your account at any time by emailing us.
- We may suspend or terminate your account if you violate these Terms, abuse the Service, or fail to pay.
- On termination, we will delete Your Data within 30 days unless we are required to retain it by law.
10. Disclaimers & limitation of liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Talent Attractor's total liability arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
12. Governing law & disputes
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Greenville County, South Carolina, and you consent to personal jurisdiction there.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll notify account holders by email and update the "Last updated" date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance.
